In which Court do you wish to present your divorce petition? You can issue your divorce in any divorce County Court or in the Principal Registry of the Family Division.

Most people will choose to use the County Court nearest to their home and the Principal Registry if they live in London.

Select the Court you will use from the list.

a.Adultery. The Respondent has committed Adultery and the Petitioner finds it intolerable to live with the Respondent.
b.Unreasonable Behaviour. The Respondent has behaved in such a way that the Petitioner cannot reasonably be expected to live with the Respondent.
c.Desertion The respondent has deserted the petitioner for a period of two years
d.2 years separation and consent. The parties have lived apart for at least 2 years immediately preceding the presentation of the petition and the respondent consents to a decree being granted;
e.5 Years Separation. The parties have lived apart for a continuous period of at least 5 years immediately preceding the presentation of the petition

PETITIONER

Guidance! Give your current address. This will also be the address where the Court will write to you about the case.

Guidance! Fill in your full name just as it appeared on your marriage certificate.
From now on you will be known as the Petitioner.

Guidance! Fill in your usual occupation. For example manager, accounts clerk, housewife, care worker, etc.

Guidance! Only answer yes if you have changed your name since you got married so that your present name is not the same as on your marriage certificate.

RESPONDENT

Guidance! Give your Respondent's address. This will also be the address where the Court will write to him/her about the case. It is essential to provide an address for the Respondent so that he or she is made aware of the divorce

Guidance! Fill in your Spouse's usual occupation. For example: shopworker, engineer, HGV Driver, sales representative, nurse etc.

From now on he/she will be known as the Respondent.

Guidance! Only answer yes if the Respondent may have changed his/her name since you got married so that their present name is not the same as on your marriage certificate.

Behaviour

Desertion The respondent has deserted the petitioner for a continuous period of at least two years immediately preceding the presentation of the petition.
